NUMBER 13-19-00127-CV NUMBER 13-19-00128-CV
04-24-2019
On appeal from the 206th District Court of Hidalgo County, Texas.
ORDER
Before Chief Justice Contreras and Justices Longoria and Perkes
Order Per Curiam
Appellant has filed two notices of appeal, and the Court has assigned a corresponding cause number to each notice of appeal.
On March 28, 2019, appellant appealed: (1) the trial court's August 24, 2018 order denying appellant's motion for traditional summary judgment and granting appellee, Farmer's Insurance Exchange's traditional motion for summary judgment; and (2) the trial court's February 26, 2019 order granting appellee's supplemental motion for summary judgment.
On April 4, 2019, appellant appealed the trial court's February 25, 2019 order denying appellant's combined motion for traditional summary judgment and granting appellee Wasp Construction, LLC's motion for summary judgment.
Appellant has since filed a motion to consolidate appeals, arguing that the appeals share overlapping subject matter and questions of law and fact, namely, both cases arise from the same personal injury suit. TEX. R. CIV. P. 174(a) (West, Westlaw through 2017 1st C.S.). Appellee is opposed and filed a response asserting that the appeals should not be consolidated.
The Court, having examined and fully considered the matters on file herein, hereby grants appellant's request for consolidation and consolidates these appeals for purposes of the record and briefing.
IT IS SO ORDERED.
PER CURIAM Delivered and filed the 24th day of April, 2019.
