United Community Bank of North Dakota v. Delorme

Supreme Court of North Dakota
Feb 25, 2004
2004 N.D. 34 (N.D. 2004)

Opinion

Nos. 20030251, 20030262

Decided February 25, 2004

Appeal from the District Court of Benson County, Northeast Judicial District, the Honorable Donovan John Foughty, Judge.

AFFIRMED.

Leo Ernest Delorme (on brief), Saint Michael, N.D. 58370, defendant and appellant.

J. Thomas Traynor, Jr. (on brief), Traynor, Rutten Traynor, P.C., 509 5th Street, Suite 1, P.O. Box 838, Devils Lake, N.D. 58301-0838, for plaintiff and appellee.

[¶ 1] Delorme appeals from a judgment granting United Community Bank of North Dakota a foreclosure of its mortgage on property owned by Delorme and from the Order approving the sheriff's sale of the foreclosed property.

[¶ 2] We conclude these appeals are frivolous and completely without merit; therefore, we summarily affirm under N.D.R.App.P. 35.1(a)(1). In addition, we award the Bank attorney's fees in the amount of $500 plus double costs under N.D.R.App.P. 38 and 39.

[¶ 3] Gerald W. VandeWalle, C.J.,

Mary Muehlen Maring,

William A. Neumann,

Dale V. Sandstrom,

Carol Ronning Kapsner.
