          STIPULATION OF VOLUNTARY DISMISSAL PURSUANT TO FED. R. CIV. P. 41(a) AND ORDER

          PHYLLIS HAMILTON, District Judge.

         IT IS HEREBY STIPULATED, by and between the parties hereto, through their undersigned counsel, that the above-captioned action is hereby voluntarily dismissed with prejudice, pursuant to Fed. R. Civ. P. 41(a).

         IT IS FURTHER STIPULATED AND AGREED that each party shall bear their own costs of suit, and neither party shall request taxation of costs by the Clerk of the Court, or attorneys' fees, pursuant to Fed. R. Civ. P. 54(d).

         IT IS SO ORDERED.
