And the legal representative of plaintiff-appellant The Estate of Helen Meimaris having moved to be substituted as plaintiff and to renew her prior motion to this Court seeking leave, pursuant to 22 NYCRR 1250.10(c), to vacate the dismissal of the appeal, and, upon vacatur, for an extension of time to perfect same (Motion No. 2023-03167), Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon,
It is ordered that the motion is granted to the extent of substituting Maria Tzanakakis, as legal representative of the Estate of Helen Meimaris, as plaintiff, and amending the caption accordingly, and extending the time to perfect to the February 2024 Term of this Court; that branch of the motion seeking to vacate dismissal of the appeal is denied as unnecessary (see CPLR 1022).
