MEMORANDUM OPINION
On March 30, 2005, Jill Bailey, as Independent Executrix of the Estate of David T. Bailey, M.D., Gregory A. Wagoner, M.D., and Charles J. Buysse, Jr., M.D., as well as other appellees, were dismissed from appeal number 10-04-00144-CV by an order of this Court. On August 30, 2006, the appeals as to Jill Bailey, as Independent Executrix of the Estate of David T. Bailey, M.D., Gregory A. Wagoner, M.D., and Charles J. Buysse, Jr., M.D. were severed from 10-04-00144-CV and made the subject of a separate appeal, number 10-06-00253-CV. Although the order of dismissal was rendered, a judgment of dismissal was not.
Accordingly, it is the opinion of the Court that the appeals of Steven S. Turoff, as Trustee of the Promedco Recovery Trust, against Jill Bailey, as Independent Executrix of the Estate of David T. Bailey, M.D., Gregory A. Wagoner, M.D., and Charles J. Buysse, Jr., M.D. pending in appeal number 10-06-00253-CV are dismissed by a judgment dated November 15, 2006.
