Turner v. State

District Court of Appeal of Florida, First District
May 5, 1992
598 So. 2d 192 (Fla. Dist. Ct. App. 1992)

Opinion

No. 91-1984.

May 5, 1992.

Appeal from the Circuit Court, Escambia County, Kim Skievaski, J.

Nancy A. Daniels, Public Defender, Carol Ann Turner, Asst. Public Defender, for appellant.

Robert A. Butterworth, Atty. Gen., James W. Rogers, Asst. Atty. Gen., for appellee.

Turner appeals a guidelines departure sentence that was based upon a valid negotiated plea agreement. His argument that notwithstanding the plea agreement the trial court was required to provide contemporaneously with the sentence its reasons for imposing a departure sentence has been rejected. Wolf v. State, 595 So.2d 1078 (Fla. 1st DCA 1992). We deny the state's motion to dismiss and affirm the conviction and sentence.

BARFIELD and ALLEN, JJ., concur.
