CECIL ARTELLE TURNER, Appellant v. THE STATE OF TEXAS, Appellee

On Appeal from the 178th District Court Harris County, Texas Trial Court Cause No. 1722813

Panel Consists of Chief Justice Christopher and Justices Zimmerer and Wilson.

ORDER

PER CURIAM

Appellant is represented by retained counsel, Stanley G. Schneider. Appellant's brief was originally due December 7, 2023. We granted three extensions of time to file appellant's brief until March 11, 2024. When we granted the most recent extension, we noted that no further extensions would be granted absent exceptional circumstances. No brief was filed. On March 13, 2024, counsel filed a further request for extension of time to file appellant's brief. To date, counsel has submitted no brief. We deny the request and issue the following order.

Accordingly, we order Stanley G. Schneider to file a brief with the clerk of this court on or before April 12, 2024. If appellant's counsel does not timely file the brief as ordered, the appeal may be abated for a hearing in the trial court to determine the reason for the failure to file the brief. See Tex. R. App. P. 38.8(b)(2).
