INSURANCE, § 488evidence as to person entitled to proceeds of life policy. Evidence warranted decree awarding proceeds of life policy to defendant, who had been substituted as beneficiary in place of insured's incompetent wife, as against contention that a fiduciary relationship existed between defendant and insured and that change of beneficiary was brought about by fraud and undue influence exercised by defendant.

Appeal from the Superior Court of Cook County; the Hon. DONALD S. McKINLAY, Judge, presiding.

Decree affirmed as modified. Heard in the third division, first district, this court at the June term, 1949.
