SC 163859 (Mich. Dec. 17, 2021)

Opinion

SC 163859 (20) COA 358323

12-17-2021

EARL FLYNN TRUSS, JR., Plaintiff-Appellant, v. GOVERNOR, Defendant-Appellee.

Monroe CC: 20-143148-CZ

Bridget M. McCormack, Chief Justice Brian K. Zahra David F. Viviano, Richard H. Bernstein Elizabeth T. Clement Megan K. Cavanagh Elizabeth M. Welch, Justices

ORDER

On order of the Chief Justice, the motion of plaintiff-appellant to waive the filing fees is DENIED because MCL 600.2963 requires that a prisoner pursuing a civil action be liable for filing fees. Within 21 days of the date of this order, plaintiff-appellant must send the Court a certified copy of his prison account activity for the past 12 months so the clerk can determine the amount of a partial fee, if any, that must be paid under MCL 600.2963 for the appeal to proceed. Failure to timely provide the account statement will result in the administrative dismissal of plaintiff-appellant's application.
