Appeal from Lee Circuit Court AFTER REMANDMENT.


The conviction of Phillip James Troha for rape in the first degree must be reversed and remanded under the direction of the Alabama Supreme Court in Ex parte Troha, 462 So.2d 953 (Ala. 1984).

REVERSED AND REMANDED.

All Judges concur.
