Respondents-appellants and petitioner-plaintiff-appellant having moved, pursuant to CPLR 5518, to vacate a temporary restraining order issued by Supreme Court, New York County, by order entered on or about June 03, 2021, pending the hearing and determination of the purported appeal taken from that order, And an interim order having been issued by a Justice of this Court, dated July 01, 2021, granting certain interim relief, Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon, It is ordered that the motion, deemed to seek relief pursuant to CPLR 5704(a), is granted to the extent of continuing the aforesaid July 01, 2021 interim order of a Justice of this Court granting the application to vacate the temporary restraining order, pending a determination by Supreme Court on the underlying motion for a preliminary injunction.
