MEMORANDUM OPINION


The Court has before it appellant's September 25, 2009 motion to dismiss the appeal. Appellant states the notice of appeal was premature and there are matters still pending in the trial court. We grant the motion and dismiss the appeal. See Tex. R. App. P. 42.1.
