Plaintiff failed to respond to either the defendant's motion to dismiss or to this Court's notice of dismissal. Both the motion to dismiss and the Court's notice were based on plaintiff's failure to serve the complaint within the time limits specified in Rule 4(m). This failure warrants dismissal of the case.

NOW THEREFORE IT IS HEREBY ORDERED, ADJUDGED, AND DECREED, that the motion to dismiss (docket no. 9) is GRANTED, and this action is dismissed in its entirety.
