THE COURT HAS ORDERED THAT:

The Report and Recommendation is approved and adopted. Defendant Travis Davis's motion for summary judgment is granted, and Plaintiff's amended complaint and this action are dismissed without prejudice as to this Defendant based upon Plaintiff's failure to exhaust his administrative remedies. Proposed Defendants Rick Scott and Brad Johanson are DISMISSED without prejudice, pursuant to 28 U.S.C § 1915A(b)(1) and 28 U.S.C. § 1915(e)(2)(B), for failure of Plaintiff to state any claim upon which relief may be granted.
