635 So. 2d 1082 (Fla. Dist. Ct. App. 1994)

Opinion

No. 93-825.

May 9, 1994.

An Appeal from the Circuit Court for Leon County; John E. Crusoe, Judge.

Nancy A. Daniels, Public Defender, and Jamie Spivey, Asst. Public Defender, Tallahassee, for appellant.

Robert A. Butterworth, Atty. Gen., Carolyn J. Mosley, Asst. Atty. Gen., and Patrick Martin, Certified Legal Intern, Tallahassee, for appellee.

Appellant's judgment and disposition are AFFIRMED. However, we remand to the trial court for correction of a scrivener's error on the community control disposition order. Appellant was found guilty of trespass on a construction site under section 810.09(2)(d), Florida Statutes. Although the order correctly lists the statute, it describes the offense as "Trespass Structure," a first-degree misdemeanor.

BOOTH, WOLF and WEBSTER, JJ., concur.
