Thomas G. Parisot, in support of the petition.

Frank N. Cassetta, general counsel, and David S. Taylor, in opposition.

The plaintiff's petition for certification to appeal from the Appellate Court, 212 Conn. App. 455, 275 A.3d 664 (2022), is granted, limited to the following issues:

"1. Did the Appellate Court correctly conclude that the defendant State Board of Labor Relations (labor board) did not act illegally, arbitrarily, or in abuse of its discretion when it declined to adopt the contract coverage standard and instead applied the clear and unmistakable waiver standard in determining whether the named defendant union, Fraternal Order of Police, Middlebury Lodge No. 34, had contractually waived its right to collectively bargain with respect to its pension plan?

"2. Did the Appellate Court correctly conclude that the trial court had applied the correct standard in reviewing the labor board's application of the clear and unmistakable waiver standard?"
