DECISION AND ORDER ON MOTION
Motion for stay pending appeal.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is granted, without costs, to the extent that defendant Salvatore Cascino shall be released from the custody of the Columbia County Sheriff pending determination of the appeal of the order of Supreme Court, Columbia County, dated December 22, 2017. This relief is granted without prejudice to a motion to vacate the stay in the event the appeal is not perfected by February 26, 2018.
