APPEAL from Bailey, J., at Fall Term, 1841, of ROWAN.

Badger for plaintiff.

Barringer for defendants.


The case is precisely the same as that of McNamara v. Kerns, ante, 66.


This case is governed by McNamara v. the same defendants. There must, therefore, be the same judgment in it.

Judgment accordingly.
