Judgment and order reversed on the law and facts, with costs, and complaint dismissed, with costs. See memorandum in companion case, Maxson v. Tomek [ ante, p. 604]. All concur. (The judgment was for damages in an automobile negligence action. The order denied defendants' motion for a new trial on the minutes.)
