ORDER


AND NOW, this 27th day of October, 2011, upon consideration of the "Emergency Application for Leave to File Appeal from Order of Court Denying Motion for Change of Venue and Request for Stay of Order of Court Garnishing Wages without a Hearing," full bench recusal of the bench of the Court of Common Pleas of Allegheny County is ORDERED, in the exercise of this Court's supervisory authority.See 42 Pa.C.S. § 726. The Court Administrator is directed to appoint a judge from out of county to preside over the underlying civil lawsuit.

To the extent that the "Emergency Application for Leave to File Appeal from Order of Court Denying Motion for Change of Venue and Request for Stay of Order of Court Garnishing Wages without a Hearing" requests a stay, it is DENIED.

It is further ordered that Respondent's request for counsel fees is DENIED.

Mr. Justice Saylor dissents.
