MEMORANDUM OPINION


The Court has before it appellee's December 12, 2008 motion to dismiss the appeal based on appellant's failure to file a brief. Appellant did not respond to the motion, nor has appellant either tendered a brief or filed an extension motion. Accordingly, we grant the motion and dismiss the appeal for want of prosecution. See Tex. R. App. P. 38.8(a).
