Thorp v. Taylor

Supreme Court of South Dakota
Dec 29, 1933
251 N.W. 801 (S.D. 1933)

Opinion

File No. 7462.

Opinion filed December 29, 1933.

Appeal and Error.

Where appellant fails to file brief within extended time set by stipulation, appeal is abandoned and judgment will be affirmed.

Appeal from Circuit Court, Marshall County.

Action by Walter W. Thorp against John Taylor. Judgment for plaintiff, and defendant appeals. Affirmed.

W.H. Morgan, of Britton, for Appellant.

Otto L. Kaas, of Britton, for Respondent.

In this case a certified copy of notice of appeal and notice of settlement of record were filed in this court on August 1, 1932. Time for filing appellant's brief was extended by stipulation to August 2, 1933. Since that time no further steps have been taken in this court, and no brief has been filed in behalf of appellant.

The appeal is therefore deemed abandoned and the judgment and order appealed from are affirmed.

All the Judges concur.
