EXHIBITIONS AND SHOWS, § 5theater patron slipping on stairway, evidence. Judgment was improperly entered for theater patron who sustained personal injuries when she slipped on a cellophane-wrapped cigaret package on a stairway while leaving the theater, as evidence did not show actual notice of presence of such package on part of defendant, nor was it there for such length of time that defendant should have known of its presence, and there was evidence that employees constantly patrolled the premises to pick up refuse, inspecting the stairway in question about every five minutes.

Appeal from Superior Court of Cook county; Hon. PETER H. SCHWABA, presiding.

Reversed. Heard in second division, first district, this court at June term, 1939.
