STIPULATION AND ORDER REGARDING DISMISSAL WITH PREJUDICE
Pursuant to Fed.R.Civ.Proc. 41(a)(1)(ii) and a confidential resolution reached between the parties, plaintiff Thoratec Corporation hereby dismisses, with prejudice, this action and all its claims against defendants Bodycote Material Testing Canada, Inc. and David C. MacGregor. Accordingly, pursuant to Fed.R.Civ.Proc. 41(a)(1)(ii) and Civil L.R. 7-11, and good cause appearing therefor, the parties hereby agree and stipulate as follows:
1. This action is dismissed in its entirety, with prejudice.
2. Each party shall bear its own costs.
