PETER THOMPSON AND MARY THOMPSON v. LOUISIANA FARM BUREAU CASUALTY INSURANCE COMPANY AND KEVIN KEARNEY


In Re: Peter Thompson and Mary Thompson, applying for supervisory writs, 19th Judicial District Court, Parish of East Baton Rouge, No. 602478.

BEFORE: PETTIGREW, THERIOT AND DRAKE, JJ.

WRIT GRANTED. We find that the trial court abused its discretion in granting Kevin Kearney and Louisiana Farm Bureau Casualty Insurance Company's motion to quash the notice of deposition of Richard Babin. The plaintiffs have made a sufficient showing that Babin possesses information, gained during the July 21, 2010 interview of Kevin Kearney, that is relevant, non-privileged, and reasonably calculated to lead to the discovery of admissible evidence regarding the circumstances of the July 12, 2010 car accident. Accordingly, the trial court's April 1, 2013 judgment that granted Kevin Kearney and Louisiana Farm Bureau Casualty Insurance Company's motion to quash the notice of deposition of Richard Babin, is hereby reversed and the matter is remanded to the trial court to proceed in accordance herewith.
