DONALD W. THOMPSON, Petitioner v. COMMISSIONER OF INTERNAL REVENUE, Respondent

ORDER

Albert G. Lauber, Judge

By Order dated October 6, 2022, this case was set for trial at a special session of the Court beginning on August 28, 2023, in Atlanta, Georgia. In that Order, the Court noted that "[t]he parties may file at their convenience a motion or joint status report proposing a pre-trial schedule." On November 18, 2022, respondent filed a Motion to Set Pretrial Scheduling Order that included a proposed pre-trial schedule. In his Motion, respondent states that prior to filing the Motion, he sent petitioner a proposed joint status report containing an essentially identical pre-trial schedule, which petitioner rejected. Respondent contends that petitioner has offered no counter-proposal to his suggested pre-trial schedule.

Upon due consideration, it is

ORDERED that petitioner shall show cause in writing, on or before December 12, 2022, why respondent's proposed pre-trial scheduling order should not be adopted.
