On order of the Court, the application for leave to appeal the May 21, 2002 judgment of the Court of Appeals is considered, and it is DENIED, because we are not persuaded that the questions presented should now be reviewed by this Court. In denying leave to appeal, the Court is not expressing an opinion regarding whether MCR 2.109 and MCL 324.1702 are in conflict, or whether the issue regarding costs is governed by the principles discussed in McDougall v. Schanz, 461 Mich. 15 (1999).

Cavanagh, Weaver, and Kelly, JJ., would grant leave to appeal.
