ORDER

Lewis R. Carluzzo, Chief Special Trial Judge.

This I.R.C. section 6330(d) case is before the Court on the motion to withdraw as counsel for petitioner submitted by Alex Mitchell and filed on August 9, 2023. The motion was heard in Atlanta, Georgia, on September 14, 2023. The parties appeared and were heard. Alex Mitchell made on oral motion to withdraw his motion, and the parties announced that a basis of settlement had been agreed upon between them.

Premises considered, and for cause set forth more fully in the transcript of the above-referenced proceedings, it is

ORDERED that the oral motion made by Alex Mitchell is granted and his motion to withdraw as petitioner's counsel, filed August 9, 2023, is withdrawn. It is further

ORDERED that unless a proposed stipulated decision is submitted sooner, the parties jointly or separately report in writing as to the status of the case.

The parties are advised that unless the case is otherwise resolved, the case will be set for trial during the Court's 2024 winter term.
