Elizabeth Thomas v. Codilis & Stawiarski P.C.

ORDER Trial court case number: 2014-54729 Trial court: 61st District Court of Harris County

On October 4, 2016, we abated this case for the trial court to clarify whether its order dated May 10, 2016 was a final judgment. On November 1, 2016, the district clerk filed a supplemental clerk's record that contained an "Amended Final Order Dismissing Plaintiff Elizabeth Thomas's Claims Against Codilis & Stawiarski P.C., For Lack of Jurisdiction." The amended final order appears to dispose of all claims and parties and thus a final judgment. See Lehmann v. Har-Con Corp., 39 S.W.3d 191, 206 (Tex. 2001). On November 2, 2016, Elizabeth Thomas filed a notice of appeal of the trial court's amended final judgment. See TEX. R. APP. P. 27.3. The parties have already filed briefs and the appellate record has been filed in this Court. Further, on November 10, 2016, Thomas filed a motion to reinstate. Accordingly, we grant Thomas's motion and REINSTATE this case on the Court's active docket. The case will be set for submission at the earliest practicable time.

It is so ORDERED. Judge's signature: /s/ Chief Justice Sherry Radack
