MEMORANDUM OPINION


On August 22, 2006, we ordered the parties in this case to mediation. On October 12, 2006, the mediator notified this Court that the case had settled. On October 13, 2006, we sent appellant a letter requesting that he file a motion to dismiss the appeal within ten days. We warned appellant that if he failed to comply with our directives within the time allowed, the appeal was subject to dismissal without further notice.

Appellant has not filed a motion to dismiss, a motion to abate the appeal, or otherwise communicated with this Court regarding this appeal. Accordingly, on the Court's own motion, we DISMISS the appeal. See Tex.R.App.P. 42.3(b), (c).
