Appellant, The HouReal Corporation, filed a notice of appeal from the trial court's final judgment. Appellant's brief was initially due to be filed on or before May 9, 2023. On motion of appellant, the Court extended appellant's deadline for filing its appellant's brief until May 30, 2023. On May 30, 2023, appellant filed its second motion for extension of time to file its appellant's brief. The Court granted appellant's motion, extending the deadline for filing an appellant's brief to June 29, 2023.
On June 28, 2023, appellant filed its third motion for extension of time to file its appellant's brief. In its third motion, appellant requests a further extension of its deadline to file an appellant's brief, to July 31, 2023. The motion states that the grounds for the request are due to counsel's other pending deadlines. The motion includes a certificate of conference stating that the requested extension is unopposed by appellee, Rescue Concepts, Inc.
Appellant's third motion to extend is granted. Appellant's brief is due to be filed no later than July 31, 2023. See TEX. R. APP. P. 10.5(b), 38.6(d). Absent extraordinary circumstances, no further extensions will be considered.
