The uncontested report of the referee is approved and respondent is suspended from the practice of law for two years to run concurrent with the two year suspension ordered in Supreme Court Case No. SC09-1466, which became effective, nunc pro tunc, February 5, 2009. Respondent shall fully comply with Rule Regulating the Florida Bar 3-5.1(g).

Respondent shall pay restitution in the amount of $2,000.00 to Julia Burry under the terms and conditions set forth in the report and the consent judgment.

Judgment is entered for The Florida Bar, 651 East Jefferson Street, Tallahassee, Florida 32399-2300, for recovery of costs from Daphane Dee Clements in the amount of $1,250.00, for which sum let execution issue.

Not final until time expires to file motion for rehearing, and if filed, determined. The filing of a motion for rehearing shall not alter the effective date of this suspension.
