Opinion

Case No. SC06-295.

October 18, 2006.

Lower Tribunal No. 2006-70,734(11L-OSC).

Respondent's Motion for Extension of Time to Respond to Subpoena filed March 22, 2006, before the Assignment of Referee, is hereby denied.

This Court appointed a referee to report to the Court concerning respondent's noncompliance with a subpoena, and the referee has filed with the Court a report of referee dated July 10, 2006, in which the referee found that the respondent has not shown good cause for his failure to comply and his failure to appear at the final hearing. The referee has therefore recommended that respondent be suspended from the practice of law until further order of this Court.

IT IS ORDERED that the respondent is suspended from the practice of law until further order of this Court. The suspension shall be effective thirty days from the date of this order so that respondent can close out his practice and protect the interests of existing clients. Respondent shall accept no new business from the date this order until further order of this Court.

Further, respondent shall show cause in writing, to be filed in this Court on or before sixty days from the date of this order, why he should not be disbarred from the practice of law and the costs of these proceedings taxed against him. Complainant may file a response to respondent's written filing within twenty days of the date it is filed.

Not final until time expires to file motion for rehearing, and if filed, determined. The filing of a motion for rehearing shall not alter the effective date of this suspension.

LEWIS, C.J., and WELLS, ANSTEAD, PARIENTE, QUINCE, CANTERO and BELL, JJ., concur.
