Tester v. State

District Court of Appeal of Florida, Second District
Dec 29, 1982
423 So. 2d 636 (Fla. Dist. Ct. App. 1982)

Opinion

No. 82-1171.

December 29, 1982.

Appeal from Circuit Court, Lee County; R. Wallace Pack, Judge.

Jerry Hill, Public Defender, and John T. Kilcrease, Jr., Asst. Public Defender, Bartow, for appellant.

Jim Smith, Atty. Gen., Tallahassee, and David T. Weisbrod, Asst. Atty. Gen., Tampa, for appellee.

Appellant questions the constitutionality of section 39.04(2)(e)(4), Florida Statutes (1979). The supreme court in State v. Cain, 381 So.2d 1361 (Fla. 1980), upheld the constitutionality of the statute in question.

Therefore, we affirm.

OTT, C.J., and RYDER and DANAHY, JJ., concur.
