Order and judgment reversed upon the law and the facts, with ten dollars costs and disbursements, and motion for judgment on the pleadings denied, with ten dollars costs, upon the ground that under the pleadings there were issues of law and fact which should be disposed of by trial at Special Term. Kelly, P.J., Manning, Young, Kapper and Lazansky, JJ., concur.
