Teitelbaum v. Waltuch

Appellate Division of the Supreme Court of New York, Second Department
Nov 1, 1917
181 App. Div. 895 (N.Y. App. Div. 1917)

Opinion

November, 1917.

Order reversed, with ten dollars costs and disbursements, and motion granted, with ten dollars costs. Upon a motion to change the place of trial in a transitory action, where the number of witnesses is about equal in each county, we think as a general rule it would be in furtherance of justice to try the case in the county where the cause of action arose, and we apply that rule in reversing this order. Thomas, Stapleton, Mills, Rich and Blackmar, JJ., concurred.
