(2) OVERRULING PLAINTIFF'S OBJECTIONS (Doc. 18); (3) DENYING
PLAINTIFF'S MOTION FOR LEAVE (Doc. 12); (4) GRANTING PLAINTIFF'S
MOTION TO ACCEPT BRIEF INSTANTER (Doc. 15); (5) DENYING
PLAINTIFF'S MOTION TO VACATE (Doc. 1); AND (6) DISMISSING THIS
CASE FOR LACK OF SUBJECT MATTER JURISDICTION
This civil case is before the Court on the Report and Recommendations of United States Magistrate Judge Sharon L. Ovington. (Doc. 17). The Magistrate Judge recommends that Plaintiff's Motion to Vacate the Arbitrator's Award be denied and that this case be dismissed for lack of subject matter jurisdiction. (Id.)Plaintiff timely filed Objections to the Report and Recommendations. (Doc. 18). Defendant filed a Response to Plaintiff's Objections. (Doc. 19). The issues are now ripe for decision by the Court.
As required by 28 U.S.C. § 636(b) and Fed. R. Civ. P. 72(b), the Court reviewed the comprehensive findings of the Magistrate Judge and the arguments of the parties de novo. Upon considering all issues de novo, the Court: (1) ADOPTS the Report and Recommendations of the Magistrate Judge in its entirety (Doc. 17); (2) OVERRULES Plaintiff's Objections (Doc. 18); (3) DENIES Plaintiff's Motion for Leave to File Memorandum Instanter (Doc. 12); (4) GRANTS Plaintiff's Motion to Accept Brief Instanter (Doc. 15); (5) DENIES Plaintiff's Motion to Vacate the Arbitrator's Award (Doc. 1); and (6) DISMISSES this case for lack of subject matter jurisdiction. The Clerk shall TERMINATE this case on the docket of the Court.
