Taylor v. State

District Court of Appeal of Florida, Fifth District
May 5, 1995
653 So. 2d 1145 (Fla. Dist. Ct. App. 1995)

Opinion

No. 94-2228.

May 5, 1995.

Appeal from the Circuit Court for Orange County, John Adams, Judge.

James B. Gibson, Public Defender and Dan D. Hallenberg, Asst. Public Defender, Daytona Beach, for appellant.

Robert A. Butterworth, Atty. Gen., Tallahassee, and Steven J. Guardiano, Sr. Asst. Atty. Gen., Daytona Beach, for appellee.

We find no error in the contested issues on appeal. The state properly concedes that conformity with Sirmons v. State, 634 So.2d 153 (Fla. 1994) requires appellant's convictions for grand theft be vacated.

AFFIRMED in part; REVERSED in part; and REMANDED.

PETERSON, GRIFFIN and THOMPSON, JJ., concur.
