  2. Langston v. Johnson

    478 F.2d 915 (D.C. Cir. 1973)   Cited 43 times

    It is well settled that a certified transcript of judicial or administrative proceedings may be considered on a motion for summary judgment. See Shulins v. New England Ins. Co., 360 F.2d 781, 785 (2d Cir. 1966) (judicial record); Fletcher v. Bryan, 175 F.2d 716, 717 (4th Cir. 1949) (judicial record); Ramsouer v. Midland Valley R. R., 135 F.2d 101, 103, 106 (8th Cir. 1943) (judicial record); Hennessey v. Federal Security Adm'r, 88 F. Supp. 664, 665 (D.Conn. 1949) (administrative record); Taylor v. Latimer, 47 F. Supp. 236, 237 (W.D.Mo. 1942) (administrative record); National Broadcasting Co. v. United States, 47 F. Supp. 940, 946 (S.D.N.Y. 1942), aff'd, 319 U.S. 190, 63 S.Ct. 997, 87 L.Ed. 1344 (1943) (administrative record); Leake v. Jones, 18 F.R.D. 80, 87 (W.D.Okl. 1955) (judicial record); Farm Bureau Mut. Ins. Co. v. Hammer, 83 F. Supp. 383, 386 (W.D.Va. 1949), rev'd on other grounds, 177 F.2d 793 (4th Cir. 1949), cert. denied, 339 U.S. 914, 70 S.Ct. 575, 94 L.Ed. 1339 (1950) (judicial record). As we have stated, each side moved for summary judgment and predicated its demand on the administrative record.

  3. Raitport v. National Bureau of Standards

    385 F. Supp. 1221 (E.D. Pa. 1974)   Cited 7 times

    This entire record may properly be considered in determining whether to grant a motion for summary judgment. See 6 Moore's Federal Practice ΒΆ 56.11(1.8) p. 2147-8 (1972); Langston v. Johnson, 156 U.S.App.D.C. 5, 478 F.2d 915, 918 (1973); Taylor v. Latimer, 47 F. Supp. 236, 237 (W.D.Mo. 1942); National Broadcasting Co. v. United States, 47 F. Bryan, 175 F.2d 716, 717 (4th Cir. 1949). From the record these facts appear:

  5. Conser v. Atchison, T. S. F. Ry. Co.

    266 S.W.2d 587 (Mo. 1954)   Cited 49 times
Finding that records did not meet the requirements for business records where they were produced by a Veterans Administration attorney in a regional office, who had nothing to do with their record keeping and there was no showing of the mode of record preparation or when records were made

The opinion also puts records of weather conditions on this same basis. Other cases cited by defendant rule admissibility of reports of physical examinations made by Veteran's Administration doctors in actions in federal courts on war insurance policies (United States v. Cole, 6 Cir., 45 F.2d 339; Third National Bank Trust Co. v. United States, 6 Cir., 53 F.2d 599) and to review a Railroad Retirement Board order (Taylor v. Latimer, D.C., 47 F.Supp. 236), and are not controlling here. (As to the kind of official records admissible under the "public documents" exceptions see 5 Wigmore, 3rd Ed. 512, Chap. LVI.) We must reaffirm our previous rulings that Section 490.680 controls the admission of hospital records and hold that defendant failed to make the showing required for admission of this hospital record, although, of course, plaintiff cannot be heard to object to the part of the record he read to the jury.
