We questioned our jurisdiction over this appeal from the trial court's order granting appellee's plea to the jurisdiction as the appeal appeared untimely. See Brashear v. Victoria Gardens of McKinney, L.L.C., 302 S.W.3d 542, 545 (Tex. App.—Dallas 2009, no pet.) (op. on reh'g) (timely filing of notice of appeal is jurisdictional). In a supplemental letter brief filed in response to our request for jurisdictional briefing, appellant requests we dismiss the appeal. Although given an opportunity to respond, appellee has not responded.
We grant the request and dismiss the appeal. See TEX. R. APP. P. 42.1(a).
