ORDER


Pursuant to the Stipulation Regarding Settlement of Plaintiff's Claims Against Defendant Bristol-Myers Squibb Company ("BMS"), filed September 10, 2004, the parties advised the Court of the resolution of Plaintiff's claims against BMS and requested that the Court refrain from ruling on Defendant BMS's pending Motions for Summary Judgment.

IT IS, THEREFORE, ORDERED that any pending Motions for Summary Judgment filed by Defendant Bristol-Myers Squibb Company are denied as moot.
