FOR APPELLANT: Joanne Sandifer, Sonni Fort Nolan, Mohsen Pasha, 190 Carondelet Plaza, Ste. 600, Clayton, MO 63105.

FOR RESPONDENT: Bridget L. Halquist, Alexander P. Atkinson, Caitlan L. Stayduhar, 8909 Ladue Rd., St. Loius, MO 63124.

Before Robert M. Clayton III, P.J., Gary M. Gaertner, Jr., J., and Thomas C. Clark, II, J.

ORDER

PER CURIAM.

Charter Communications, LLC, d/b/a Charter Communications ("Charter") appeals the trial court's denial of its motion to dismiss and compel arbitration or, in the alternative, to stay proceedings pending arbitration ("motion to dismiss and compel arbitration") of Kellan Tate's underlying lawsuit against Charter for, inter alia , violations of the Missouri Human Rights Act. We find the trial court's denial of Charter's motion to dismiss and compel arbitration is not erroneous.

No jurisprudential purpose would be served by a written opinion. We have, however, provided the parties a memorandum setting forth the reasons for our decision. The decision of the trial court is affirmed under Rule 84.16(b).
