MEMORANDUM AND ORDER PURSUANT TO RULE 1:28

We discern no error in the judgment dismissing the plaintiff's complaint. As a threshold matter, we observe that the plaintiff has not included a copy of the complaint in the record appendix; he accordingly has furnished no basis for us to assess his claim that dismissal of the complaint was in error. Moreover, the record reveals no basis to question the observation by the motion judge that the plaintiff did not comply with the order of the Superior Court entered on December 8, 2010, in filing his complaint. So far as appears in the record, that order remains in effect, and (even were we to consider the present appeal to present a question of the propriety of that order) the plaintiff has offered no persuasive grounds for relief from its requirements.

Judgment affirmed.
