BUILDING AND CONSTRUCTION CONTRACTS, § 95compensation of superintendent, sufficiency of evidence. In action on contract for services rendered in superintending construction of a church, judgment below for plaintiff was reversed, where evidence showed that a licensed architect was hired to superintend, and plaintiff claimed he was to receive the same compensation, 2 per cent of the cost, for the same work, the alleged contract had been made with a priest who subsequently died, and although there was some testimony that the priest had said plaintiff was to receive same compensation as he had for superintending a convent, there was no evidence as to the cost of the convent or compensation received.

Appeal from Municipal Court of Chicago; Hon. LAMBERT K. HAYES, presiding.

Reversed. Heard in first division, first district, this court at October term, 1939.
