ORDER TERMINATING PLAINTIFF'S MOTION RE: DKT. NO. 18

On January 16, 2024, Plaintiff Blake Swann, proceeding pro se, filed a complaint against Pat Gelsinger, the CEO of Intel Corporation, and Lisa Su, the CEO of Advanced Micro Devices (AMD), claiming unfair business practices. See Dkt. No. 1. After screening Plaintiff's complaint and reviewing the supplemental materials he submitted, Magistrate Judge Beeler issued a Report and Recommendation finding dismissal appropriate in light of the complaint's failure to establish jurisdiction or state a claim. Dkt. No. 14. Judge Martmez-Olgum adopted the R&R in full, and dismissed Plaintiff's complaint without prejudice. See Dkt. No. 16. A few weeks later, Mr. Swann filed a document styled as a “motion/counterattack,” which enclosed excerpts of his email communications with AMD, and affixed a handwritten cover page that, while hard to read, appears to request a new judge. See Dkt. No. 18. Shortly thereafter, the case was assigned to the undersigned.
Because Dkt. No. 18 does not constitute an amended complaint responsive to the deficiencies identified in the court's orders, the Court will TERMINATE it AS MOOT. To the extent Plaintiff chooses to file anything further on the docket, that filing must be an amended complaint that addresses the deficiencies explained in the R&R. Otherwise, this case remains closed per Dkt. No. 16.
