Richard Suzio v. Ascension Providence Hospital

LC No. 2020-182684-NH

Elizabeth L. Gleicher Presiding Judge Mark J. Cavanagh Colleen A. O'Brien Judges

ORDER

The motion for reconsideration is GRANTED and this Court's August 3, 2022 order is VACATED in part to the extent that the order stated that "[t]he trial court did not abuse its discretion by rejecting the two motions unrelated to the request to extend the dispositive motion heard-by deadline." Upon further review, it was unclear following the May 11, 2022 hearing whether the trial court extended the dispositive motion heard-by deadline for all dispositive motions and when such motions were due. Accordingly, defendants reasonably relied on the language stated in the May 31, 2022 order when they filed their motions that the trial court rejected. We therefore direct the trial court to accept all three of defendants' motions for consideration.

The Court retains no further jurisdiction.
