Opinion

Case No. 2:00-C V-1417

January 2, 2002

ORDER

This matter is before the Court following Plaintiff's failure to respond to this Court's November 29, 2001 Order to Show Cause as to why the Defendant's September 28, 2001 Motion for the Sanction of Dismissal should not be granted. The Defendant seeks dismissal for Plaintiff's failure to answer in any way to Defendant's discovery requests. The Court granted Plaintiff eleven (11) days in which to respond to the Court's Order. The Plaintiff has failed to do so. Consequently, the Court concludes that the sanction of dismissal is appropriate. The Defendant's Motion to Dismiss (Doc. #16) is GRANTED.

This action is hereby DISMISSED. The Clerk is DIRECTED to enter Judgment accordingly.

IT IS SO ORDERED.
