DECISION & ORDER ON MOTION

Motion by the appellant, inter alia, (1) to strike the respondent's brief on an appeal from an order of the Supreme Court, Suffolk County, dated May 10, 2010, on the ground that it refers to matter dehors the record, (2) to strike the respondent's brief on appeals from two orders of the same court, both dated November 1, 2010, on the ground that it refers to matter dehors the record, and (3) to enlarge the time to serve and file a reply brief in connection with the appeals from the orders dated November 1, 2010.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branches of the motion which are to strike the respondent's briefs are held in abeyance and referred to the panel of Justices hearing the appeals for determination upon the argument or submission thereof; and it is further,

ORDERED that the branch of the motion which is to enlarge the time to serve and file a reply brief on the appeals from the orders dated November 1, 2010, is granted, the appellant's time to serve and file a reply brief is enlarged until December 26, 2012, and the reply brief must be served and filed on or before that date; and it is further,

ORDERED that the motion is otherwise denied.
