June 9, 1939.

Action in the district court for Ramsey county to recover for personal injuries sustained by plaintiff when struck by defendant's auto. After a directed verdict for defendant, plaintiff appealed from an order, Richard D. O'Brien, Judge, denying his motion for a new trial. Affirmed without opinion by equally divided court.

Samuel A. Anderson and Russell M. Carlson, for appellant.

Walsh Walsh, for respondent.



Mr. Justice Hilton being incapacitated by illness and the other members of the court being equally divided on the questions presented by this appeal, the order of the trial court is affirmed without opinion.

Affirmed.
