An appeal having been taken to this Court from an order of the Supreme Court, New York County, entered on or about June 15, 2022, which set forth a discovery schedule after a preliminary conference, And plaintiff-respondent having moved for a declaration that certain facts presented to this Court were misrepresentations; for sanctions in the amount of $20,000 for said misrepresentations; and to vacate the preliminary injunction granted by this Court on September 06, 2022 (M-2022-02905) which stayed the enforcement of the June 15, 2022 order pending the hearing and determination of the appeal, Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon, It is ordered that the motion is denied.
